BP Oil Claims for Texas Businesses – Galveston, Chambers, Jefferson & Orange Counties

Comments Off

BP is currently in the process of deciding whether to sale its interest in a Russian oil joint venture. It is estimated that the sale will result in a $15,000,000,000.00 windfall for BP shareholders. Why do I think this is worth mentioning? The news is all about BP and its Russian oil profits. Where is the news about the harm caused by BP when the deepwater horizon rig sent millions upon millions of barrels of oil into our Gulf of Mexico?

If you live in Galveston, Chambers, Jefferson or Orange County Texas, you are not eligible to make a claim in the proposed BP Oil Claim settlement pending in New Orleans. When you look at the map of the states involved: Texas, Louisiana, Alabama, Mississippi and Florida – you can definitely see that Texas got the short end of the stick. Only four counties in Texas are included while for most of the other states it is a much greater area of the respective state included.

Texas BP oil claimants must also prove causation related to the BP Oil Spill. While it may be difficult to prove that business declined due to the BP oil spill, accounting and financial records should be very helpful in assisting in proving that business declined during the time period negotiated in the settlement. How will you prove the causation if you are a business owner in Galveston, Texas? My suggestion is that you become very familiar with the thousand page settlement document or you retain an attorney who is handling the BP Oil Spill claims to assist you. I would also suggest that you ask your CPA or bookkeeper to help prepare financial documents that meet the requirements of the settlement agreement. Don't worry too much about the cost of your CPA or bookkeeper. The settlement agreement allows for CPAs and bookkeepers to charge by the hour for their time to assist you.

Who has a claim in Texas. If you live in Galveston, Chambers, Jefferson or Orange counties and own a business, you have a potential claim no matter what type of business you are in. Those in the restaurant or seafood related business may have better claims but it truly doesn't matter what type of business you are in.

If you would like to discuss your rights, please give me a call. The call is confidential and there is no charge for our consultations. Please be mindful that there are applicable time periods so it is always a good idea to move quickly to make sure your claim is timely filed.
